Fr- -1 <br />600K <br />Tim Zorc, 3907 58'h Circle, complained that homeowners in Hammock Lakes were <br />not informed about this hearing. He had received notice Monday, January 10', which was <br />sent out on December 31' . He inquired about the property owners within 300' notification <br />requirement. <br />Director Boling responded thatproperty owners within 300' and beyond were notified <br />and the notices for this meeting were mailed on January 3'. <br />Mr. Zorc continued that the County should have gotten more involvement from the <br />neighbors. He inquired about specifics on the calculation of the open areas, which Director <br />Boling detailed for him. While he did not favor this project, he did favor permitting a <br />community to name its inner streets rather than have to use numbered designations. He <br />found the grid numbering assignments confusing. He offered that Vero Beach is unique and <br />thought a 50' lot will not work here. He predicted that other developers will mirror this <br />project and its use of attached products. Other developers have been able to fill a niche for <br />a larger size product. <br />Mr. Hirschfeld inquired about the abutting properties and the procedural legality of <br />this hearing. <br />County Attorney Vitunac explained that the item had received subjective analyzation <br />by professional staff and the Planning and Zoning Commission and now it is before the <br />elected officials. Their decision either way will be sustainable. This is a legislative <br />procedure, not quasi-judicial. The Board can make a decision either way and their decision <br />cannot be challenged, in his opinion. Enough evidence has been presented for the record <br />to find that this is a legal proceeding. <br />Mr. Hirschfeld stated that 90% of the Hammock Lakes owners objected to the project <br />on his petition. He felt it would have been 100% had he been able to contact all of them. <br />He then read a letter into the record from Patricia Mozel containing her objections and <br />January 11, 2000 <br />0 0 <br />
