Acce!tance ofDonated Property - Non Exclusive Easement and <br />Quit --Claim Deed - Right -of- Way from Marvin Carter <br />The Board reviewed a Memorandum of February 21, 2000: <br />TO: The Board of County Commissioners <br />FROM: tot William G. Collins 11— Deputy County Attorney <br />DATE: February 21, 2000 <br />SUBJECT: Acceptance of Donated Property <br />Attached for acceptance please find a Non -Exclusive Easement for general utility <br />and drainage purposes, as well as a Quit -Claim Deed for two parcels of property <br />totaling 1.88 acres +/- from Marvin E. Carter as successor trustee. <br />The drainage and utility easement overlays 36"' Avenue from the canal south of <br />Martin Luther King Boulevard (45"' Street) to 43'd Street. <br />The quit -claimed right-of-way overlays the east '/2 (50 feet) of 38th Avenue from <br />the canal south of Martin Luther King Boulevard (45th Street) to 43rd Street; and <br />the North '/Z (30 feet) of 431d Street between 36th Avenue and 38th Avenue. <br />Neither instrument warrants good title, so the County obtains only such tittle as <br />the Carter Trust may have. <br />RECOMMENDATION: <br />Accept the donated Non -Exclusive Easement and Quit -Claim Deed. <br />ON MOTION by Commissioner Ginn, SECONDED BY <br />Commissioner Stanbridge, the Board unanimously accepted the <br />donated Non -Exclusive Easement and Quit -Claim Deed for <br />right-of-way overlays from Marvin E. Carter, as Successor <br />Trustee of the Gertrude M. Carter Trust dated 4/22/91, as <br />recommended in the memorandum. <br />March 7, 2000 <br />24 <br />_I <br />
