U <br />required sidevard setbacks from 14' to 10'. This setback modification did not affect the preliminary <br />plat design, including lot sizes and layout. The approved preliminary PD plan is consistent with the <br />approved and modified conceptual PD plan, and proposes 15 detached single-family homes on <br />individual lots with reduced setbacks. Subsequent to preliminary plan/plat approval, a land <br />development permit was issued for construction, and construction has commenced. The owner, <br />Vernon G. Foster, through his agent, Shalloway, Foy, Rayman and Newell, Inc., is now requesting <br />final plat approval and has submitted the following: <br />A final plat for Pelican Pointe Phase II PD in conformance with the approved preliminary <br />plat. <br />2. A cost estimate for the remaining required subdivision improvements. <br />A contract for construction of the remaining required subdivision improvements. <br />4. A letter of credit to guarantee construction of the remaining required improvements. <br />ANALYSIS: <br />At this time, construction of some of the required subdivision improvements has commenced. The <br />applicant has submitted a contract for construction for all of the remaining required subdivision <br />improvements, along with a letter of credit to secure the contract. Both the county engineering <br />division and the utility services department have approved the cost estimate and have verified that <br />the letter of credit amount is adequate to cover the estimated cost of the remaining required <br />improvements. The county attorney's office has approved the construction contract for legal form <br />and sufficiency and has approved the format of the letter of credit. <br />All applicable requirements regarding final plat approval have been satisfied. Pursuant to the <br />county's LDRs, the applicant will be required to obtain a certificate of completion from public works <br />after construction of the required improvements. At that time, the applicant will separately warranty <br />the utility improvements via a Utility Services department Bill of Sale. Since no other improvements <br />are being dedicated to the public, no other warranties will be required. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of County Commissioners grant final <br />PD plan/plat approval for the Pelican Pointe Phase II Planned Development and authorize the <br />chairman to sign the contract for construction and accept the letter of credit that secures the contract. <br />APRIL 4, 2000 <br />-31- BOO ,';iC <br />• <br />
