He believed he had first asked about a variance on the setbacks and, as had been <br />explained, the criteria for a variance does not work. This zoning change appears to be his <br />only option. <br />It was determined that no one else wished to be heard and the Chairman closed the <br />public hearing. <br />ON MOTION by Vice Chairman Ginn, SECONDED BY <br />Commissioner Tippin, the Board adopted by a vote of 4-1 <br />(Commissioner Stanbridge opposed) Ordinance No. 2000- <br />014 amending the Zoning Ordinance and the Accompanying <br />Zoning Map for a ±0.54 acre tract located on the northern part <br />of the barrier island, approximately 700 feet west of Jungle Trail <br />and a quarter mile south of CR510, from RS -1 to RS -6. <br />ORDINANCE NO. 2000-014 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR A ±0.54 ACRE TRACT <br />LOCATED ON THE NORTHERN PART OF THE BARRIER ISLAND, APPROXIMATELY 700 <br />FEET WEST OF JUNGLE TRAIL AND A QUARTER MILE SOUTH OF CR 510, FROM RS -1 <br />TO RS -6; AND DESCRIBED HEREIN, AND PROVIDING SEVERABILITY AND EFFECTIVE <br />DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />May 2, 2000 <br />61 <br />BOOK 113 PAGE '44 <br />
