• <br />• <br />On June 10, 1999, the Planning and Zoning Commission granted preliminary plat approval for the <br />proposed small lot subdivision. The developer subsequently obtained a land development permit <br />and commenced construction of the required subdivision improvements. The developer is now <br />requesting final plat approval and has submitted to planning staff the following: <br />1. A final plat in conformance with the approved preliminary plat. <br />2. An Engineer's Certified Cost Estimate for remaining required improvements. <br />3. A contract for construction of required improvements. <br />4. A letter of credit to guarantee construction. <br />ANALYSIS: <br />While most of the required improvements have been completed, the applicant has chosen to "bond - <br />out" remaining work in order to proceed with final plat approval. The Public Works and Utility <br />Services Departments have reviewed and approved the submitted Engineer's Certified Cost Estimate <br />and corresponding letter of credit amount, and the County Attorney's Office has reviewed and <br />approved the submitted Contract for Construction. Prior to recording the plat, the developer will <br />submit the letter of credit, which represents 115% of the estimated cost to complete the required <br />improvements. It should be noted that all improvements within the Grace Oaks development will <br />be public and the applicant will need to provide a warranty maintenance agreement and financial <br />security to warranty the publicly dedicated improvements when a certificate of completion is <br />obtained. All final plat requirements have been satisfied. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of County Commissioners: <br />1. Grant final plat approval for Grace Oaks, and <br />2. Authorize the Chairman to execute the submitted Contract for Construction of Remaining <br />Required Improvements and accept the letter of credit that secures the contract. <br />ATTACHAIENTS: <br />1.
