matter. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in this <br />Bruce Barkett, attorney representing Red Stick Golf Course, believed Red Stick to be the <br />only golf course affected by the impact fee since October 1, 1999 when the fees became effective. <br />Red Stick was approved for preliminary planned development last April. When they applied for a <br />building permit, they were informed that the impact fee had changed to be based the acreage. Mr. <br />Barkett had sent a letter to each of the Commissioners outlining Red Stick's position: that acreage <br />has no relevance to the amount oftraffic generated by a golf course. The County's consultant agreed <br />that the number of holes is a much fairer and better way to determine the impact of a golf course on <br />traffic. Red Stick has 316 acres but only 140 acres is playable. The difference in acreage does not <br />have a bearing on how many players will be generated. Based on acreage, Red Stick; had to pay a <br />$98,000 impact fee. Under this proposed ordinance, Red Stick's impact fee would be $68,000, a <br />substantial savings of $30,000. In his research, he found that legislation which is intended to be <br />curative or remedial in nature should be retroactive. He reiterated that he believed Red Stick to be <br />the only golf course which had to pay the impact fee during the time it was in effect. He urged the <br />Board to adopt the ordinance and to make it retroactive to October 1, 1999. <br />In response to Chairman Adams' inquiry, Director Boling advised that the ordinance would <br />become effective when filed with the State of Florida unless the Board specified that it should be <br />retroactive in its motion. <br />It was determined that no one else wished to be heard and the Chairman closed the public <br />hearing. <br />ON MOTION by Commissioner Macht, SECONDED BY <br />Commissioner Stanbridge, the Board unanimously adopted Ordinance r <br />No. 2000-023 amending certain sections of the Land Development <br />Regulations (LDRs) in Chapter 953, Fairshare Roadway <br />Improvements, and directed that the same shall be retroactive to <br />October 1, 1999. <br />July 18, 2000 <br />22 <br />BK 114 PG 230 <br />
