RESOLUTION NO. 2000- 079 <br />WHEREAS, such a designation provides a benefit to abutting lot owners by reducing <br />building setbacks on abutting lots; and <br />WHEREAS, the Board of County Commissioners is authorized to designate a county right- <br />of-way as a "limited use right-of-way'; and <br />WHEREAS, Indian River County desires to designate three segments of county right-of-way <br />within the Vero Lake Estates subdivision, Units C, F, I, and J as "limited use rights-of-way", said <br />rights-of-way segments being: <br />1. "801' Street" from 98`h Avenue to 94`h Court, and <br />2. "841' Street" from 101" Court to 100"' Court, and <br />3. "86" Street" from 102"d Avenue to 95th Avenue. <br />and shown on the attached map (SEE EXHIBIT "A"); and <br />WHEREAS, Indian River County has determined that all lots that abut the subject rights-of- <br />way have frontage on other county road rights-of-way that provide general vehicular access to each <br />abutting lot; and <br />WHEREAS, Indian River County has notified by regular mail owners of record of the lots <br />that abut the subject rights-of-way segments of the public meeting at which the Board of County <br />Commissioners will consider designating the subject rights-of-way as "limited use rights-of-way". <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The subject segments of county rights-of-way are hereby designated as "limited use rights-of- <br />way" as defined and referenced in the county land development regulations, and shall not be used <br />for general vehicular traffic purposes but may be used for pedestrian, drainage, and utility uses <br />authorized by the county. <br />The foregoing resolution was offered by Commissioner Ti Mi n who moved <br />its adoption. The motion was seconded by Commissioner Stanhridap- <br />put to a vote, the vote was as follows: and upon being <br />Chairman Fran B.
