0 <br />will run with the land. Said notice shall be recorded in the Indian <br />River County public records, at the applicant's expense. <br />Note: The applicant is willing to enter into such an agreement. A condition <br />of approval is needed to ensure that the agreement on market rate <br />leasing is executed prior to site plan release. <br />(j) If the use of a non -camouflaged tower is abandoned for more than <br />twelve (12) consecutive months, then the tower shall be dismantled <br />and removed from the site. <br />(a) Prior to release of an approved tower site plan, the property <br />owner shall acknowledge in writing, in a manner acceptable <br />to the county attorney's office, his or her responsibilities as <br />the property owner to perform or contract to perform and pay <br />all costs associated with dismantling and properly removing <br />and disposing of an abandoned tower. <br />Note. The applicant is willing to agree to pay all costs associated with <br />removing and disposing of the tower if it is abandoned for more than <br />12 consecutive months. A condition of approval is needed to ensure <br />that the removal and disposal agreement is executed prior to site plan <br />release. <br />(k) Except where superseded by applicable state or federal regulations, <br />non -camouflaged towers shall be painted or constructed in neutral <br />color (e.g. non -contrasting gray or blue) to blend into the surrounding <br />environment. <br />Note: The tower will be constructed of a standard, non -contrasting steel <br />gray material. <br />(1) Except for the exemptions cited below, non -camouflaged towers over <br />one hundred fifty (150) feet tall shall be separated as follows: <br />a. Proposed lattice towers over one hundred fifty (150) feet in <br />height shall be separated a distance of at least five thousand <br />(5,000) feet from existing or approved lattice towers over one <br />hundred fifty (150) feet in height. and at least one thousand <br />five hundred (1,500) feet from existing or approved non - <br />lattice towers (over one hundred fifty (150) feet in height). <br />b. Proposed non -lattice towers over one hundred fifty (150) feet <br />in height shall be separated a distance of at least one thousand <br />five hundred (1,500) feet from existing and approved non - <br />camouflaged towers over one hundred fifty (150) feet in <br />height. <br />AUGUST 8, 2000 <br />on I 14 PG 501 <br />
