r <br />0 <br />Exemptions. <br />Tower applications shall be exempt from the separation <br />distance requirements specified above, as follows: <br />(1) Where the tower is proposed to be located more than <br />two thousand five hundred (2,500) feet from any <br />public road and from any existing residence; or <br />(2) where the applicant can demonstrate that applying the <br />separation distance criteria to his or her application <br />would result in a net increase in the number of <br />communications towers needed. <br />(3) where the tower is proposed to be clustered with <br />another tower(s) by being located no more than two <br />hundred (200) feet from the tower(s) within the <br />cluster. <br />Note: The only existing tower within 5,000 feet of the proposed tower is the <br />AT&T guyed (non -lattice) tower located along C.R. 507. That tower <br />is more than 1,500 feet from the proposed tower, which satisfies the <br />above cited separation distance requirements. <br />Staff concludes that all applicable specific land use criteria for the proposed tower are <br />satisfied. <br />15. Dedications and Improvements: The LDRs do not require any dedications or <br />improvements connected with the proposed development. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of County Commissioners grant <br />special exception use approval for the requested multi -tenant tower with the following conditions: <br />1. Prior to site plan release, the applicant shall enter into agreements with the county to: <br />a. Acknowledge and commit to providing tower space at market rate cost for other <br />parties and interests; and <br />b. Acknowledge and commit to removing and disposing of the tower if it is abandoned <br />for more than 12 consecutive months and to paying for all removal and disposal <br />costs. <br />Planning Director Stan Boling stated the application is for a new tower north of <br />Fellsmere and staff recommends approval with conditions. The County has only had 2 <br />applications since the 1996 and 1997 workshops on towers.
