I <br />the paving project. <br />Jean Cool owns property directly across from the Amoco and the road is already <br />paved. She questioned why she had to pay for paving that had already been done. <br />R. J. MacMillan, 305 Live Oak Road, was the owner of Oslo Trade Center on 18'h <br />Avenue. The business is located on 18" Avenue SW, which is paved. Part of their <br />Developer's Agreement specifies that when they build their warehousing, they will have to <br />pave 10'h Avenue SW. He thought spot -paving was not a good idea and that the entrance off <br />20'h Avenue was a help to all parties. Concerning the assessment being based on square <br />footage, he thought it was fair to assess his property based on that even though there was <br />already paving on one side. <br />It was determined that no one else wished to be heard and the Chairman closed the <br />public hearing. <br />Public Works Director James W. Davis wished to address some of Mrs. <br />Sommerfroind's comments. First, he reported Mr. MacMillan has signed the petition and <br />is in concurrence with the petition. Second, he pointed out that in paragraph 21 in the <br />Developer's Agreement, there is a very important "if' and Mr. Cooksey had been told from <br />the start that the County could not guarantee that a special assessment would be approved. <br />If it is, and if it is the Board's desire to include the whole project as staff has recommended, <br />then the developer would be reimbursed. That paragraph was added to the Developer's <br />Agreement prior to approval of the agreement. <br />Director Davis explained that there are two ways to qualify a petition, it can be signed <br />by 2/3rds of the property owners or by 2/3rds of the owners with front footage.
