4. A completed Contract for Construction of remaining improvements required by the <br />project design, and <br />5. A letter of credit to secure the construction. <br />ANALYSIS: <br />All of the improvements required by county land development regulations (LDRs) have been <br />completed, and the applicant has obtained a certificate of completion. There are minimal <br />improvements, such as curbing, which are not required by the LDRs but are required by the project <br />design. These remaining project -required improvements are being guaranteed by the applicant via <br />a cash escrow agreement. The cash escrow amount represents 115% of the cost of the improvements <br />and will be submitted prior to recording. <br />Public Works has reviewed and approved the engineer's certified cost estimate for completing the <br />remaining project -required improvements and corresponding cash bond. The County Attorney's <br />Office has approved the contract for construction. It should be noted that all improvements within <br />the Grand Harbor development are private, with the exception of certain utility facilities. Also <br />included is a cash deposit and escrow agreement to guarantee the utilities bill of sale of utility <br />facilities. The cash deposit and escrow agreement has been approved by the County Attorney's <br />Office. With the referenced contract for construction and corresponding cash escrow agreements, <br />all final plat requirements are satisfied. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of County Commissioners: <br />1. Grant final plat approval for Harbor Island (Plat 23), and <br />2. Authorize the Chairman to execute the submitted Contract for Construction of <br />remaining project -required improvements and cash escrow agreements. <br />ATTACHMENTS: <br />1.
