• • <br />Pine Tree Park, Plat Book 2, Page 17, reserving the entire right- <br />of-way as a drainage and utility easement. <br />RESOLUTION NO. 2000-096 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF THE PORTION <br />OF 6TH STREET AND 7TH STREET IN PINE TREE PARK, PLAT BOOK 2, PAGE <br />17 RESERVING THE ENTIRE RIGHT-OF-WAY AS A DRAINAGE AND <br />UTILITY EASEMENT, SAID LAND LYING IN INDIAN RIVER COUNTY, <br />FLORIDA <br />WHEREAS, on May 5, 2000 Indian River County received a duly executed and documented <br />petition from Pinetree Park Lake POA of Florida, requesting that the County close, vacate, abandon, <br />discontinue, renounce and disclaim any right, title and interest of the County and the public in and <br />to a portion of 6th Street Pinetree Park unit 2, Plat Book 3, Page 46, and 7th Street in Pine Tree Park <br />unit 1, Plat Book 3, Page 38, said lands lying in Indian River County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to <br />consider said petition was duly published; and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and <br />report, and testimony of all those interested and present, the board finds that the subject right-of-way <br />is not a state or federal highway, nor located within any municipality, nor is said right-of-way <br />necessary for continuity of the County's street and thoroughfare network, nor access to any given <br />private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the public in and to that certain right-of-way <br />being known more particularly as: <br />That part of Palm Street (now known as 7th Street), lying West of a line drawn between the <br />S.E. corner of Lot 12, Block D, and the N.E. corner of Lot 9, Block E, as shown on the plat of <br />Pinetree Park, Unit 1, recorded in Plat Book 3, Page 38 of the Public Records of Indian River <br />County, Florida. Containing 6,600 square feet. <br />Now lying in Indian River County, Florida. <br />That part of Willow Street (now known as 6th Street), lying West of a line drawn between the <br />S.E. corner of Lot 12, Block H, as shown on the plat of Pinetree Park, Unit 1, and the N.E. corner <br />of Lot 9, Block A, as shown on the plat of Pinetree Park, Unit 2, recorded respectively in Plat Book <br />3, Page 38 and Plat Book 3, Page 46 of the Public Records of Indian River County, Florida. <br />Containing 6,600 square feet. <br />Now lying in Indian River County, Florida <br />September 5, 2000 <br />57 <br />BK1I4PG791 <br />
