DeBloi< AICP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Zedek <br />Code Enforcement Officer <br />DATE: 09/28/2000 <br />RE: DUVIVIER / RIEMER REQUEST FOR RELEASE OF EASEMENT <br />AT 1870 OCEAN WAY (LOT 8, BLOCK E, SEAGROVE SUB UNIT 3) <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of October 10, 2000. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by Roger and Edna Duvivier, who recently sold a lot at 1870 <br />Ocean Way to Michelle Marie Riemer, for release of a ten foot wide rear yard utility easement on <br />the lot, in Seagrove Subdivision Unit 3. The purpose of the easement release request is to allow for <br />a existing pool deck, built in 1984, in the easement (see attached map). When the Duviviers sold <br />the lot to Ms. Riemer, a portion of the sale proceeds were held in escrow due to the easement <br />encroachment, pending County release of the easement. The Duviviers have requested that the <br />easement release be granted to Ms. Riemer, the current lot owner. <br />ALTERNATIVES AND ANALYSIS <br />The request has been reviewed by Bell South Communications; Florida Power & Light Corporation; <br />T.C.I. Cable Corporation; the Property Owners Association; the City of Vero Beach Utilities and <br />Power Department; the County Road & Bridge and Engineering Divisions; and the County surveyor. <br />None of the utility providers or reviewing agencies expressed an objection to the requested release <br />of easement.
