documents from the State of Florida indicating the presence or absence of a Murphy <br />Act Easement along 1T" Street S.W. <br />The Thoroughfare Plan classifies 27' Avenue as an urban collector which requires <br />130' of right-of-way. Since there is 50' of r -o -w existing, the applicant will need to <br />dedicate, without compensation, 5' of fee simple right-of-way to complete the site's <br />local road fairshare of 60'. The site's 27' Avenue frontage is covered by a Murphy <br />Act Easement, which extends 100' into the site. Therefore, no additional right-of- <br />way beyond the 5' dedicated area is needed from the site. The plan does not propose <br />any improvements within the Murphy Act Easement, and provides for appropriate <br />setbacks from the Murphy Act easement line. <br />The Thoroughfare Plan classifies 43`d Avenue as a major rural collector, which <br />requires 100' of right-of-way. Since there is a 100' canal right-of-way between 43rd <br />Avenue and the subject site, no additional right-of-way is necessary from the subject <br />site for 43'd Avenue. <br />12. Traffic Circulation: The applicant is proposing the project's primary access to be from 43'd <br />Avenue (major rural collector), with a second access to 27' Avenue (urban collector) in a <br />later phase. The Public Works Director has indicated that he will not approve direct access <br />to 43'd Avenue, but will allow the applicant to construct a portion of 17' Street S.W. to gain <br />access to 43"d Avenue via 17' Street S.W. Based on LDR sections 952.12(2)(a) and <br />952.12(2)(g), the Public Works Director has discretion in approving requests for multiple <br />access connections to a project. The applicant is seeking to have the 431 Avenue entrance <br />approved as shown, and proposes direct access to it. As stated previously, the Planning and <br />Zoning Commission agreed with the applicant on this point. It is the opinion of the Public <br />Works Director that the project access be from 27' Avenue and 17t° Street SW only. <br />Planning staff and the Planning and Zoning Commission recommended that the applicant <br />provide a connection to 17' Street SW, and the applicant is agreeable to providing a <br />connection to 17' Street SW in addition to the private driveway connection to 43'd Avenue <br />that is shown on the conceptual plan. Again, the private connection to 431 Avenue is not <br />acceptable to the Public Works Director. <br />A traffic impact analysis (TIA) has been reviewed by the county's traffic engineering <br />division. The TIA is based on the proposed connection to 43'd Avenue as depicted on the <br />proposed plans. The traffic engineering division has not approved the TIA since it is based <br />on a 43'd Avenue connection. Therefore, if the 43id Avenue connection is not approved, the <br />TIA will need to be revised to reflect the revised connection locations. Based upon the TIA <br />that has been reviewed, the following improvements could be required. <br />1. A south bound left turn lane on 43'd Avenue at the project entrance. <br />2. A south bound right -tum land on 27" Avenue at the project entrance. <br />These improvements will need to be constructed when the proposed access points are <br />constructed, if said access points are approved. <br />13. Utilities: Connection to public water and wastewater, and utilization of reuse water are <br />required and proposed by the applicant. These utility provisions have been approved by the <br />Health Department and the County Department of Utility Services.
