• <br />Acreage: ± 90.61 acres (± 5.93 ac. uplands, ±.84.68 ac. wetlands) <br />t.AAC Recommendation: The County Land Acquisition Advisory Committee (LAAC), at its meeting on <br />October 25, 2000, voted unanimously to recommend that the Board of County Commissioners purchase the <br />subject parcels. <br />Princig ai Condition: Closing subject to County Commission and FCT Governing Body approval <br />The proposed acquisition consists of eight of the nineteen tax parcels in the Oyster Bar Salt Marsh project. <br />and —91 acres (-62 %) of the total —147 acre project. The overall project was approved in 1998 as a Florida <br />Communities Trust (FCT) 50150 cost -share project. <br />Oyster Bar Salt Marsh was added to the LAAC acquisition list in 1997. The project is ranked 11 out of 13 <br />sites on the current LAAC acquisition list. County bond funds are available for the purchase under the first <br />series $15 million bond issuance (see Attachment #5). <br />In its application for state cost -share funding, the County chose to be the lead agency for pre-acquisition <br />tasks and negotiations. During the past year, the county's acquisition consultant, in coordination with county <br />staff. has conducted pre-acquisition tasks and negotiations. Since the sellers recently accepted and executed <br />purchase contract Option Agreements, appraisal results and other confidential information can now be <br />released. <br />Procedures adopted by the Board of County Commissioners for environmental land acquisition include <br />confidentiality of appraisals. In accordance with the County's Land Acquisition Guide, and Section 125.355 <br />of the Florida Statutes, appraisals can be released for public information once an option agreement is <br />executed between a seller and the County. Regarding the Simmons and Andre parcels, option agreements <br />have been executed (binding the sellers to a negotiated purchase price), and subsequently the appraisals were <br />released from confidentiality. <br />When a county exercises its confidentiality right in purchasing real property, Section 125.355, F.S. requires <br />that the county approve the purchase at a public meeting not less than 30 days after appraisals are released <br />and public notice of the meeting is given. Since the Chairman of the Board of County Commissioners, <br />pursuant to authority delegated by the Board, executed a purchase option for the Simmons and Andre parcels, <br />and since appraisals of the parcels were made public at that time, the Board must now consider whether to <br />exercise its purchase option. Consistent with Chapter 125. F.S. requirements, this decision will be made at <br />the November 7, 2000 public meeting of the Board of County Commissioners. By having given 30 days <br />public notice of this proposed action, the County will have complied with Chapter 125 requirements as well <br />as LAAC Guide requirements to hold a public hearing before purchasing property with land acquisition bond <br />funds. <br />The County Land Acquisition Advisory Committee, at its meeting on October 25, 2000, voted 12-0 to <br />recommend that the Board approve the purchase contracts. <br />The eight parcels' natural areas include impounded salt marsh (± 85 acres), and tropical maritime hammock <br />with some Brazilian pepper disturbance (± 5.93 upland acres). The parcels have ± 865 feet of road frontage <br />on SR AIA. The upland portion of the property is zoned RS -3, Single -Family Residential, up to 3 units per <br />acre. The wetlands portion of the property is zoned Con -2, Conservation, 1 unit per 40 acres (with a transfer <br />of density right (TDR) of 1 unit per acre). <br />November 7, 2000 <br />123 <br />• <br />
