Keating, AICP <br />Community Development Dhrector <br />4-31 <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: November 1, 2000 <br />SUBJECT: Attorney Michael O'Haire's Appeal on Behalf of Ken Godfrey of a Planning <br />and Zoning commission Decision to Deny a Site Plan and Administrative <br />Permit Application for a Sand Mine at CR 507 (Babcock) and 99a' Street <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of November 7, 2000. <br />BACKGROUND: <br />At its September 14, 2000 meeting, the Planning and Zoning Commission voted 7-0 to deny a site <br />plan and administrative permit application from Ken Godfrey for a sand mine on a site at CR 507 <br />(Babcock) and 991e Street. Subsequently, Attorney Michael O'Haire, on behalf of Mr. Godfrey, <br />appealed that decision, and staff has scheduled the appeal to accommodate the appellant's schedule. <br />For reference, staffs report on the Godfrey sand mine application and the Planning and Zoning <br />Commission minutes are attached (see attachment #2). According to the county's land development <br />regulations (LDRs), appeals of decisions of the Planning and Zoning Commission are considered <br />by the Board of County Commissioners, which is authorized to review the Commission's decision <br />and approve, approve with conditions or deny the subject site plan and administrative permit <br />application. <br />November 7, 2000 <br />165 <br />
