<br />• TO TOE HONORABLE BOARD OF COUNTY COldwISSIONERS OF INDIAN RIVER COUNTY, FLORIDA:

<br />Pursuant to Chapter 22870, Acts of the Florida Legislature session of 1945, the City
<br />of Vero Beach, Florida represents that it has been the owner in fee simple at all times subse-
<br />'quent to March 29, 1940, of property situated in Indian River County, Florida, d3seribed as
<br />'follows, to -wit:
<br />Lot 5 in Block 1, and Lots 5 and 12 in Block 2, of Walter Kitching's Subdivision,
<br />,according to plat thereof filed in the office of the Clerk of the Circuit Court of St. Lucie
<br />County, Florida, in Plat Book 4, at page 5;
<br />subject only to such rights as may have been Enquired therein by Indian River County, Florida
<br />'under and by virtue of the provisions of Chapter 22079, Acts of Legislature of 1943; that con-
<br />iveyance of said property is represented by Deed frtJohn T. Ezell and Valentine Shaw Ezell, his
<br />wife, as grantors, to the City of Vero Beach as Grantee, dated March 29, 1940 and duly acknowledg-
<br />ed by the grantors on said date and on said date delivered to the City of Vero Beach and which
<br />Deed is recorded in Deed Book 27, at page 154, public records of Indian River County, Florida.
<br />That the name and address of the owner of said property prior to the acquisition of
<br />title thereto by said County under said Chapter 22079, is the City of Vero Beach, Vero Beach,
<br />'Florida.
<br />That the date of the Final Decree under which the title to said lands Was quieted in
<br />Indian River County is August 14, 1944.
<br />The price of said lands as previously fixed by resolution of the Board'of County Com-
<br />missioners of Indian River County, Florida,is $600.00 (Lot 5-$200.00 Lots 5 & 124400.00).
<br />The use to which the lands were enjoyed by said City of Vero Beach, Florida at the
<br />time of entry of said Final Decree was municipal uses as to portions thereof and for sale purer
<br />poses or for exchange of other properties needed fdr municipal purposes as might be determined
<br />by the governing body of the City of Vero Beach, Florida.
<br />That said City is using parts of said property for public street purposes and that the
<br />,
<br />remaining portions of said properties not in use for public street purposes we needed for ex-
<br />change with private owners in order to obtain privately owned property in other locations neede
<br />?for public street purposes and that acquisition of said property by Indian River County was
<br />;i through oversight of the City of Vero Beach, Florida, and unless remedied would render a hard-
<br />ship upon the citizens of said City and the general public.
<br />That by reason of ownership of said property by the City of Vero Beach, Florida, there
<br />are no municipal taxes or taxiliens thereon and that said City herewith offers and tenders eerti-
<br />lied check in the amount of the sum of $238.09 in payment of all taxes upon said property which
<br />,had become delinquent prior to the quieting of title therein in Indian River County together
