The price of said lands as previously fixed by Resolution of the Board of County Com-' missioners of Indian River County, Florida, is $1625.00. The use to which the lands were enjoyed by said City of Vero Beach, Florida, at the time of entry of said Final Decree was municipal uses as to portions thereof and for sale pur- poses or for exchange of other properties needed for municipal purposes as might be determined by the governing body of the City of. Vero Beach, Florida. That said City is using parts of said property for municipal purposes and that such part or all of said properties as shall not be used for municipal purposes are needed for ex- change with private owners in order to obtain privately owned property in other locations need- ed for municipal purposes or for sale to private purchasers and that acquisition of said pro- perty by Indian River County was through oversight of the City of Vero Beach, Florida, and un- less remedied would render a hardship upon the citizens of said City and the general public. That by reason of ownership of said property by the City of Vero Beach, Florida, there are no municipal taxes or tax liens thereon and that said City herewith offers and tenders cer- tified check in the amount of the sum of $523.91 in payment of all taxesuponsaid property which had become delinquent prior to the quieting of title therein in Indian River County to- gether with interest and costs provided by law and subsequently accrued taxes for current and omitted years and which amount is represented by certificate of.the Clerk of the Circuit Court of Indian River County, Florida, attached to and made a part of this Petition. WHEREFORE the City of Vero Beach, Florida respectfully petitions that by proper reso- lution the Board of County Commissioners of Indian River County approve this Petition and ac- cept the said sum herewith tendered in full consideration of conveyance by said County to said City of the above described lands and that thereupon the said Board execute such proper convey- ance thereof. Pursuant to the foregoing Petition, Commissioner Helseth introduced the following Re- solution and moved its adoption to -wit: - - - - - - - - - - - - - - - - WHEREAS, pursuant to Chapter 22870 Acts of Florida Legislature, 19459 the City of Vero Beach, Florida, has filed with the Board of County Commissioners of Indian River County, Flori- da, a verified written Petition stating that lots situated in Indian River County, Florida, ' described as follows, to -wit: Lots 2, 39 4, and 5 in Block 2 of Edgewood Addition, in the City of Vero Beach, as per record- ed plat thereof; have become the property of Indian River County under the provisions of Chapter 220792 Acts of Florida Legislature, 1943 and by virtue of Decree entered in the Circuit Court of Indian River County, Florida on April 16, 1945 and which Petition sets up the name and address of the City of Vero Beach, Florida and recites that said City was the owner of said lots at the time of the. entry of such Decree and sets up the price of the use to which such lots were enjoyed by such former owner at the time of the entry of said final Decree and a statement of the facts and circumstances upon which such former owner basis the request for the restoration of the des- cribed property and an offer to pay an amount equal to all taxes, including municipal taxes and liens, if any which had become delinquent, together with interest and cost provided by law and together with any snubsegftently accrued taxes which had not been assessed and representing cur- rent and omitted years.
