APPROVAL OF MINUTES <br /> MEETING OF FEBRUARY 25, 2008 <br /> ON MOTION by Commissioner Davis, SECONDED By Board <br /> Member MacKay, the Board unanimously approved the Minutes <br /> of February 25, 2008, as written. <br /> 5. ACTION ON SPECIAL MAGISTRATE'S <br /> RECOMMENDATIONS TO DENY RELIEF FOR <br /> PETITIONS 2007-0393, 2007-0394, 2007-0395, 2007-0396, <br /> AND 2007-0397 <br /> Information provided for review <br /> A. Special Magistrate Worksheets <br /> Chairman O'Bryan reminded the Board that at their last meeting of February 25, <br /> 2008, they voted to not accept Special Magistrate John Robinson's <br /> recommendations to grant relief on the five subject properties, and granted a <br /> rehearing with a different Special Magistrate, and this meeting was the result of <br /> that rehearing. <br /> Attorney William G. Collins II, stated that the Special Magistrate Michael <br /> Armbruster held the re-hearings for the subject petitions, and recommended to the <br /> Board to deny relief for all five petitions. Attorney Collins explained that Special <br /> Magistrate Armbruster wrote up findings on each petition specifically, and among <br /> his findings he wrote that the Agent Sheila Anderson did not have a method to <br /> support her argument. He wrote that the evidence included post-January 1St data, <br /> and it was difficult to organize it to overcome the Property Appraiser's <br /> presumption of correctness. Attorney Collins pointed out that although Agent <br /> Anderson did not show for the rehearing, the Special Magistrate did review the <br /> evidence that was presented by her at the first scheduled hearing. <br /> 2 <br />
