Baird, County Administrator <br /> THROUGH: Jason Brown, Director, OMB <br /> • <br /> FROM: Beth Martin, Risk Manager,` <br /> DATE: June 12, 2015 1I�t��II'''"' <br /> SUBJECT: Mediated Settlement; James Pasqualone <br /> It is requested that the Board of County Commissioners consider the following Consent <br /> Agenda item at their June 23,2015 regular meeting. <br /> Background <br /> On June 11, 2015 the County Administrator reviewed and approved the $135,000.00 <br /> settlement of the July 9, 2011 workers' compensation claim of James Pasqualone, a <br /> former fire fighter who retired July 10, 2012. Settlement of the indemnity portion of this <br /> claim, including attorney's fees and costs, was recommended by defense counsel, the <br /> third party claims administrator, and County staff. Additionally, the excess insurance <br /> carrier has approved this settlement. To date, $256,389.24 has been paid and the self- <br /> insured retention is $350,000.00. As a result, the actual cost for the County is <br /> approximately$94,000.00. While the medical costs for the claim will remain open, those <br /> costs will be reimbursed to the County from the excess carrier. <br /> Recommendation <br /> In keeping with administrative policy, staff now requests Board approval of this <br /> settlement in the amount of$135,000.00.
