n/9/))B( rnw/-11 .tint. )Ow <br />RESOLUTION NO. 96- 54 <br />A RESOLUTION IN SUPPORT OF REVISING THE <br />CONSULTANTS' COMPETITIVE NEGOTIATION <br />ACT TO ALLOW GOVERNMENT AGENCIES TO <br />REQUEST ESTIMATES OF COSTS AND EXPENSES <br />PRIOR TO THE COMPETITIVE SELECTION <br />PROCESS BEGINNING WITH A CONSULTANT. <br />WHEREAS, the Board of County Commissioners of Indian <br />River County, Florida, has made the following determinations: <br />1. Section 287.055, Florida Statutes, provides the guidelines <br />for the selection of professional architectural, engineering, landscape <br />architectural, or surveying and mapping services known as the <br />Consultants' Competitive Negotiation Act. <br />2. Under this Act, Indian River County is able to select in <br />order of preference, the most highly qualified firms to perform the <br />required services based on various criteria such as the ability of the <br />personnel, whether the firm is a certified minority business <br />enterprise, its past performance, willingness to meet time and budget <br />requirement, location, etc. <br />3. Once the Consulting firm has been selected, the county <br />negotiates a contract with that firm for professional services at <br />compensation which the County determines to be fair, competitive, <br />and reasonable. <br />4. This Board believes that the selection of consultants should <br />be as competitive as possible and the Consultant's Competitive <br />Negotiation Act limits true competition because estimates of costs and <br />expenses are not negotiable until the top firm has been selected <br />thereby prohibiting competition in its true sense. <br />1 <br />
