• <br />.om: <br />,nt: <br />To: <br />Subject: <br />Linda & Ron irspicer@spacey.net] <br />Wednesday, October 16, 2002 12 00 PM <br />Margaret Gunter <br />River Island dock permit violation <br />Please add the subject permit violation on the County Commissioners Meeting <br />agenda for discussion on October 22, 2002. <br />Than you, Ron Spicer <br />589-2331 <br />Ron Spicer explained in detail his opinion that code violations are occurring and that <br />staff had not been responsive to his concerns. He felt that the Code Enforcement Department had <br />acted in favor of the developer, rather than the citizens, and objected to being told by staff that he <br />would need to have a survey prepared to further his claim. <br />Chief of Environmental Planning and Code Enforcement Roland DeBlois, with the aid of <br />several maps, photographs and an aerial from March of 2001 (COPIES OF WHICH ARE ON <br />FILE WITH THE BACKUP FOR TODAY'S MEETING), explained the investigative actions <br />taken by staff. He noted that the development in question is a planned development and the <br />County has required the developer to put the docks in this area to protect the Indian River Lagoon <br />and the sea grasses in the area Staff has explained to Mr. Spicer that there is no indication of <br />any violation. On the opposite side of the canal there are 3 corner lots, each fronting on east - <br />west canals. There would be no docks projecting from the opposite shoreline because these <br />owners would be directed to construct their docks on the east -west canals. <br />In response to questioning, Mr DeBlois continued that the developer has now sodded the <br />banks so the issue of the silt screen has been resolved. <br />Commissioner Ginn stated that she had visited the area and felt that the Board has no <br />alternative but to accept the docks as they are being constructed. There are mangroves now <br />growing in the area making an excellent place for fish to breed. <br />Commissioner Adams thanked staff for their efforts and also thanked Mr. Spicer for his <br />concerns. This situation has been going on for 8 months now and there does not appear to be a <br />comfortable resolution to the problem. <br />Chairman Stanbridge noted that there are always compensations to be made when an old <br />platted subdivision is developed and there is little the Board can do about those situations. <br />Mr. Spicer felt he would have to contest statements made by staff regarding sea grasses <br />and environmental impacts because he did not believe them to be true. <br />Commissioner Tippin emphasized that he has known most of the staff for 15 to 18 years <br />and is not accustomed to having them tell untruths. <br />OCTOBER 22, 2002 <br />25 <br />• <br />7 <br />
