Napier, SRPA, SRA 0,1 <br />Right -of -Way Agent <br />SUBJECT: Children's Home Society - Oslo Road Property <br />Re -acquisition of Land Parcel by County <br />DATE: October 1, 2001 <br />n <br />ra <br />DESCRIPTION AND CONDITIONS <br />In 1991, the Board of County Commissioners deeded the subject property to the Children's <br />Home Society of Florida (The Society), at a price of $25,000. A condition of the transaction <br />was that within one year, the Society would build and maintain a shelter for runaway <br />children. No shelter was ever built on the property. <br />In 1995, the Board granted a five year extension to the Society. At that time, a modified <br />conveyance was provided stating that, should the Society fail to build the facility within the <br />extended time period, the County could record a resolution declaring a failure of a <br />condition of the conveyance of the property and return the $25,000, and the property would <br />revert to Indian River County. <br />In July 1999, Amanda McGee, Executive Director of the Society again came before the <br />Board and asked for permission to be able to sell the property on the open market, without <br />restrictions. Public Works Director, Jim Davis indicated that the parcel might be needed <br />for stormwater use in conjunction with the proposed Oslo Road improvements, and asked <br />that the County be given first right -of -refusal on the property. The Society agreed with this, <br />and the Board approved the request, with Administrator Chandler pointing out that the <br />matter would have to come back before the Board, should Public Works determine the site <br />is needed for stormwater use. <br />OCTOBER 23, 2001 <br />-101- <br />At <br />T <br />
