ORDINANCE NO, 2001-031 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, REGARDING <br />LANDSCAPE MATERIAL REPLACEMENT STANDARDS, AMENDING THE <br />FOLLOWING CHAPTER OF THE LAND DEVELOPMENT REGULATIONS <br />(LDRS): CHAPTER 926, LANDSCAPE AND BUFFER REGULATIONS; AND <br />PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS, CODIFICATION, <br />SEVERABILITY AND EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA THAT THE INDIAN RIVER COUNTY <br />LAND DEVELOPMENT REGULATIONS (LDRS) BE AMENDED AS <br />FOLLOWS: <br />1. LDR section 926.12(3) is hereby amended to read as follows: <br />"(3) Replacement of required landscaping. Required landscaping that has died or has been <br />removed shall be replaced by material which is equivalent to the size that the material should <br />have attained from the time of project C.O. (certificate of occupancy), as follows: <br />From zero (0) to eighteen (18) months after project C.O. , landscape materials may <br />be replaced at the sizes indicated on the approved site plan. <br />FFeRi More than eighteen (18) months after project C.O., <br />replacement shrubs shall be a minimum of thirty (30) inches in height, replacement <br />canopy trees shall be a minimum of sixteen (16) feet in height and three (3) inches <br />in diameter at 0.5 feet above grade, and replacement understory trees shall be a <br />minimum of seven (7) feet tall with a one and one-half (1 %) inch diameter at 0.5 feet <br />above grade. <br />arm <br />ZHM <br />AWRIERRM <br />WE <br />2. Repeal of Conflicting Provisions <br />All previous ordinances, resolutions, or motions of the Board of County Commissioners of <br />Indian River County, Florida which conflict with the provisions of this ordinance are hereby <br />repealed to the extent of such conflict. All special Acts of the legislature applying only to the <br />unincorporated portion of the Indian River County which conflict with the provisions of this <br />ordinance are hereby repealed to the extent of such conflict. <br />3. Codification <br />The provisions of this ordinance shall be incorporated into the County Code and the word <br />" „« <br />Ordinance may be changed to "section", , article„ , or other appropriate word, and the sections <br />of this ordinance may be renumbered or re -lettered to accomplish such intentions. <br />4.
