Keith McCully, P.E., Esq., Storiirwater Engineer <br />SUBJECT: <br />DATE: <br />MEMORANDUM OF UNDERSTANDING BETWEEN THE ST. <br />JOHNS RIVER WATER MANAGEMENT DISTRICT AND INDIAN <br />RIVER COUNTY FOR SEDIMENT, FLOW REDUCTION, AND <br />OTHER WATER QUALITY DYJPROVEMENTS WITHIN THE INDIAN <br />RIVER FARMS WATER CONTROL DISTRICT <br />January 9, 2002 <br />DESCRIPTION AND CONDITIONS <br />The Florida legislature has approved $4.33 million for design and construction of stormwater <br />improvements in Indian River County within the Indian River Fauns Water Control District <br />(IRFWCD). Until recently, the county and St. Johns River Water Management District (SJRWMD) <br />have disagreed on how this money is to be passed through from the state to the county, and on which <br />entity will have control over the design and construction of improvements recommended by the <br />Stounwater Master Plan. The attached Memorandum of Understanding (MOU) addresses these <br />issues and was negotiated on the County's behalf by Conunissioner Stanbridge with assistance from <br />the Stormwater Engineenng Department. It has been signed by the SJRWMD Governing Board and <br />is now presented to the County Commission for its approval and signature. The MOU favorably <br />deals with all of the county's concerns. It gives the county control over the design and construction <br />of the recommended Stormwater Master Plan improvements, and allows SIRWMD to act in its <br />traditional role as a regulatory permitting agency. As the projects are approved by SJRWMD, it will <br />release the pertinent funding from the $4.33 million legislative allocation. (In a related agenda item <br />the Board will consider approving a Work Order between the county and its stormwater consultant <br />which will lead to the conceptual design of the projects covered under the MOU.) <br />RECOMMENDATIONS <br />Staff recommends that the Board of County Commissioners authorize the Chairman to execute the <br />attached Memorandum of Understanding between SJRWMD and Indian River County. <br />FUNDG <br />N/A <br />ATTACHMENTS <br />1.
