Attorney fees and costs $ 2 . 000 . 00 Total $ 1229659 . 00 RECOMMENDATIONS AND FUNDING Staff recommends the Board of County Commissioners approve the $ 122 , 659 . 00 cost for right-of-way and drainage improvements and authorize the Chairman to execute the Agreement. Public Works Director Jim Davis explained that the County ' s drainage retention pond and the developer ' s retention pond are being consolidated into one pond . This plan will make certain that the County ' s work on King ' s Highway is not held up waiting for design and construction of the retention pond . Should the County need the pond first , a temporary pond would be constructed and the developer would come in later and finish construction . Commissioner Stanbridge expressed her concerns about the pond and expressed a desire for County staff to work closely with the developer to make the pond more functional and attractive . Chairman Ginn felt the County should require aeration as a minimum requirement to a keep these ponds healthy . It is not that expensive . Director Davis commented that staff has been looking at different techniques for better maintenance of these stormwater ponds . ON MOTION by Commissioner Tippin , SECONDED by Commissioner Stanbridge , the Board unanimously approved the $ 122 , 659 cost for - right- of-way and drainage improvements and authorized the Chairman to execute the Developer ' s Agreement with Lake Grace of Vero Beach , LLC and/or assignees , as recommended by staff.
