F � '`�`�pw�,� <br /> a; a <br /> • the sidewalk has been eliminated; <br /> • the road profile width has been minimized to the extent practicable while still accounting <br /> for vehicular access , safety and stormwater management; <br /> • fill volume and elevation has been reduced; and <br /> • a native vegetation buffer has been added between the proposed road and future <br /> residences . <br /> ANALYSIS <br /> Comprehensive Plan & Land Development Regulations <br /> Regarding scenic and historic roads, Comprehensive Plan Recreation and Open Space Policy 8 . 3 states <br /> that: <br /> " These [scenic/historic]- roads will be used as access ways, open space, and corridors <br /> incorporating passive and active recreational activities while maintaining their primary <br /> historical importance. " <br /> Section 933 . 08 (4) of the County Historic and Archaeological Resources Protection Ordinance reads as <br /> follows : <br /> "( 4 ) Management and protection of scenic or historic roads. The public works department of Indian River <br /> County. the parks department and the community development department shall implement guidelines for <br /> maintenance of the scenic and historic roads . The following guidelines apply to all scenic and historic <br /> roads : <br /> ( a) Clear cutting of vegetation in the protected area of any scenic or historic road shall be prohibited, <br /> except under circumstances where sight lines are obstructed and contribute to traffic hazards ; <br /> (b) The cutting of selective vegetation within the protected area shall be allowed upon the <br /> recommendation of the community development department and approval of the county planning <br /> and zoning commission; <br /> ( c ) The establishment of planting strips within the protected area to be comprised of native vegetation <br /> shall be allowed upon approval of the community development director; <br /> (d) Improvements for providing adequate drainage for the roadbed and surrounding properties , and a <br /> program of maintenance to ensure the continued effectiveness of the systems may be established; <br /> (e) The selective removal of trees and other vegetation from the protected area shall be allowed when <br /> such are damaged bevond restoration. In all cases, all such activity will comply with the Indian <br /> River County Tree Protection Chapter; <br /> (f) Individual management plans for scenic and historic roadways may set additional restrictions or <br /> requirements for these roadways : <br /> 1 . The additional considerations of Resolution No . 89- 39 "Jungle Trail Management Plan" <br /> shall be applied to all projects. zonings, uses, and other activities in the vicinity of the <br /> historic roadway of Jungle Trail. " <br /> As described in Recreation and Open Policy 8 . 3 , Old Winter Beach Road, like other designated scenic <br /> and historic roads, is to be used as an access way for recreation , while maintaining the roadway ' s <br /> "primary historic importance . " Neither the Comprehensive Plan nor County land development <br /> regulations explicitly prohibit the paving of Old Winter Beach Road, provided that public access and <br /> "historic importance" are maintained . <br /> The question facing the County is whether paving of Old Winter Beach Road under the revised design <br /> would be detrimental to the scenic and historic character of the roadway .
