Ile felt a dangerous precedent could be set if they alloxythe <br /> same land to be used for storinwater management and building purposes which could result <br /> in a significant increase in density throughout the county . He objected to the density of the <br /> property pointing out specific areas on a site map where the canal was used to increase that <br /> density . He pointed out that the County had riparian rights in the River Boat Club under an <br /> agreement . He opined it was inappropriate to use the canal for purposes of calculating <br /> density requirements . He cited the Brickell case and the Coastal Petroleum case in the <br /> Florida Supreme Court which address these issues . If the canal was navigable in 1845 , then <br /> it would be considered navigable waters and title to the underlying land would belong to the <br /> State of Florida ( Trustees of the Internal Improvement Fund ) and not to the developers . He <br /> felt that this was , at least , an issue . Finally . it was represented that there are 12 units now <br /> on the property and there are currently only 9 electrical meters . Also , several of the units are <br /> hotel units , not single - family or multi - family residences . He felt the reduction of density <br /> argument was flawed , because he thought this proposal would increase the density , traffic , <br /> and the burden on the environmentally sensitive neighborhood . He hoped the developer <br /> would come back with a site plan to put a nice development on the property with separate <br /> on - site stormwater management . He urged the Board to not allow this over- use of the <br /> property ; it overburdens the land and the stormwater management system is completely <br /> unacceptable . He also pointed out that the developer was claiming ownership of submerged <br /> lands , but the title to property adjusts with the high water line . The submerged land should <br /> be deducted from their calculations and the buffer setbacks should be measured from the <br /> ordinary high water line of the river . <br /> Randy Mosby , Mosby and Associates , responded to concerns of the Commissioners <br /> and comments of Mr .
