<br /> Recommendation :
<br /> It is recommended that the Board of County Commissioners authorize the county
<br /> attorney to engage the law firm of Johnson , Anselmo , Murdoch , Burke & George , P . A . , to
<br /> represent the County in the above - referenced case absent a defense provided by another
<br /> P a rty .
<br /> Discussion :
<br /> The above - referenced lawsuit naming Indian River County , inter alia , and alleging
<br /> Americans with Disabilities Act violations at Dodgertown , was served on Commissioner
<br /> Macht . I have been informed that the Florida Municipal Insurance Trust will not provide a
<br /> defense . I am in the process of reviewing the Dcdgertown transaction documents and
<br /> communicating with the Dodgers ' counsel to determine whether a defense will be provided .
<br /> If not , I contemplate engaging the law firm of Johnson , Anselmo , Murdoch , Burke &
<br /> George , P . A . , which is located in Fort Lauderdale , to defend the County . Michael T . Burke ,
<br /> Esq . , of Johnson , Anselmo , has informed me that he is willing to bill the County at the rate
<br /> negotiated through the Florida League of Cities . i
