Welch <br />Vero Beach <br />Florida <br />Dear Mr. Welch: <br />The Board of County Commissioners of Indian River County have instructed me to advise <br />you that in connection with obtaining additional right of way for widening and paving State Road <br />5-505-A, locally known as the Lateral "B" and the King's Highway road, the County agrees as <br />follows: <br />1. Upon a conveyance by you of the right of way required for this work, the County <br />will pay to you the sum of $1,800.00. <br />2. The County agrees to reconstruct on the new right of way line the drainage structures <br />consisting of reinforced concrete bulkhead to which is attached screw-type irrigation gate and <br />18 inch corrugated drain pipe to the canal and reestablish the same in good condition. <br />3. The County agrees to cut off the existing artesian well on the new right of way at <br />a sufficient depth to prevent the road construction interferring with the well and piping the <br />well underground to come to the surface West of the new right of way line and the County further <br />agrees that if the well is damaged by virtue of it being under the right of way or if the flow <br />of water is impeded because of the angles in the well, the County will repair the well or recon- <br />struct the same so that you will receive the flow of water therefrom as the same now exists. <br />4. Kendall <br />Vero Beach <br />Florida <br />Dear -Mr. and Mrs. Kendall: <br />In consideration of your conveyance of the right of way described in State Road De- <br />partment Deed No. 2, Section 8$55, State Road No. S -505-A, Indian River County, Florida, the <br />County does herewith agree as follows: <br />1. The line between your property and that being conveyed in the above deed is a <br />foot or so to 'the South of the hedge and concrete posts located at the Northwest corner of your <br />property so that the hedge and posts will be in the right of way which you are conveying. The <br />County has consulted with the State Road Department and the State Road Department has assured <br />the County that this road can be constructed without interfering with the hedge and posts men- <br />tioned. The County does herewith assume the responsibility and does herewith assure you that <br />the posts and hedge will not be damaged or moved from their present location until after July 1, <br />1953. After this date, if you desire, the County will move the hedge and posts back on your <br />property and set them up and reestablish them in good condition as they now exist. <br />2. The County agrees to reestablish the three road outlets which you have from your <br />property on to the above described road in good condition as they now exist. <br />3. The County agrees to reestablish the two drainage outlets which you now have from <br />your property along this right of way line in good condition as they now exist. <br />4. You may remain in possession of the right of way described in the above deed until <br />construction of the road begins.
