In accordance with State procedures, the next step is for the FCT <br />Goveming Body and the County, City and Town to execute a "Conceptual Approval Agreement" (CAA) for <br />the cost -share funding project. Attached is the CAA for the Board's approval consideration. <br />ANALYSIS <br />The CAA consists of standard language and conditions pursuant to Rule 9K 4, Florida Administrative Code, <br />which is the rule that sets forth FCT program procedures. Since the Board, at its meeting of February 5, 2002, <br />opted to take a "pre-acquisition" approach to purchasing the Lost Tree Islands, the CAA is structured as a <br />reimbursement grant. In accordance with FCT requirements, the acquisition can be considered a 'pre- <br />acquisition" if the project is purchased within 18 months of the grant approval (i.e., on or before February <br />13, 2003). <br />The Agreement consists of ten main sections, as follows: <br />I General Conditions <br />u Audit Requirements <br />Iu Affirmations, Annual Stewardship Report, Authorized Executor and Federal <br />Identification Number <br />IV. Management Plan Approval <br />V. Project Plan Approval <br />VI. Project Site Acquisition Requirements Imposed by Chapter 259 and Chapter <br />380, Part III, F.S. <br />'VII. <br />VIII Obligations of the FCT Recipient as a Condition of Project Funding <br />Obligations of the Recipient Relating to the Use of Bond Proceeds <br />IX. Disallowable Activities/Remedies <br />Y. Conditions Particular to the Project Site Plan that Must be Addressed in the <br />Management Plan <br />The General Conditions section of the agreements contains standard language pertaining to timing and <br />coordination of steps between the County and FCT, and among other things identifies the key contact from <br />the County for purposes of coordinating project activities. <br />The Audit Requirements section specifies audit requirements under Section 215.97, F.S., the Florida Single <br />Audit Act. <br />Affirmations, Annual Stewardship Report, Authorized Executor and Federal Identification Number: <br />this section identifies the representatives of the County, City and Town authorized to execute documents <br />associated with the project. (Consistent with past FCT projects, the Board Chairman is proposed as the <br />County's representative, subject to full Board authonzation). This section also specifies the F(.21 requirement <br />of an annual stewardship report to be provided by the County <br />The Management Plan Approval section outlines required elements of a conceptual management plan that <br />must be completed prior to FCT funding reimbursement. <br />Project Plan Approval outlines County documents required prior to FCT disbursement of State funds, <br />including a statement of total project costs, a signed agreement for acquisition, a certified survey, title <br />insurance and an environmental assessment. <br />Project Site Acquisition Requirements Imposed by Chapter 259 and Chapter 380, Part III, F.S. <br />specifies that the local recipient (the County) will have title to the project, and that State will have a <br />reversionary interest. A Grant Award Agreement, which spells out conditions of the grant award, is required <br />to be recorded upon closing with the FCT for cost -share funding reimbursement. <br />Obligations of the FCT Recipient as a Condition of Project Funding ensures that any use of project <br />property once acquired will be consistent with the adopted management plan, or, if changes are proposed, <br />that FCT approval is first obtained. <br />March 5, 2002 <br />106 <br />70] <br />
