Obligations of the Recipient Relating to the Use of Bond Proceeds requires the County to notify FCT if <br />any use of project property is proposed that may affect State bond proceeds used in acquiring the property, <br />with respect to legal and tax consequences. This section also outlines disallowable activities. "Disallowable <br />activities" are specifically listed and include the operation of concessions on the property, and "any use of <br />the project site by any person other than in such person's capacity as a member of the general public." <br />Disallowable Activities/Remedies provides that the County will cease any disallowable activities on the <br />project property upon written notification from the FL 1, as applicable, and that the FCT will be held harmless <br />from all claims relating to disallowable activities. This section also provides that the FCT has the right to seek <br />an injunction against the County for any disallowable activities. <br />Conditions Particular to the Project Site Plan that Must be Addressed in the Management Plan <br />reflects information presented to FCT in the grant application, including revisions deemed appropriate by the <br />FCT, relating to proposed site improvements and use. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners approve the attached Conceptual Approval <br />Agreement, and authorize the Board Chan man to sign the Agreement. Staff also recommends that the Board <br />authorize staff to coordinate with the City and the Town for approval of the Agreement. <br />ATTAC <br />[ENTS <br />1.
