GINN - REPORT ON TRIP <br /> TO TALLAHASSEE REGARDING HABITAT <br /> CONSERVATION PLAN AND GERSTNER AND <br /> SUMMERPLACE SEAWALLS <br /> Chairman Ginn stated that her trip had been to seek some resolution to the Gerstner <br /> seawall matter . In talking with staff from the Department of Environmental Protection , there <br /> is some disagreement as to the terms of the Habitat Conservation Plan . She wanted to be <br /> certain that her understanding that the Plan would mitigate the initial takes from the Gerstner <br /> and Summerplace seawalls was correct . <br /> Commissioner Adams confirmed that the HCP encompasses all 22 miles of Indian <br /> River County coast line and , in return , the Gerstner and Summerplace seawalls were allowed <br /> to be completed . <br /> Chairman Ginn commented that there had been some discussion from DEP staff that <br /> the seawalls might have to be moved . <br /> Commissioner Adams stated that the issue of private property rights has been an issue <br /> from the "get- go" . The seawall is 6 feet landward of the original permit specifications and <br /> it has been an ongoing battle for 3 and '/2 years . <br /> Chairman Ginn reiterated that DEP may be interpreting the HCP some other way . <br /> NO ACTION NECESSARY OR TAKEN , <br /> MAY 19 2001 <br /> BK 1 18 PiG 1389 <br /> - 77 - <br />
