DESCRIPTION R CONDITIONS : <br /> Attorney Steve Henderson , as agent . is requesting abandonment of a number of rights - of- w' ay on <br /> behalf of the St . John ' s River Water Management District . The nshts - ot- wav are part of the <br /> Fellsmere Farms Company Subdivision and are located south of the Town of Fellsmere and east of <br /> Willow Street (Please see attachment #2 ) . The majority of the rights -of- wav run east/west . while <br /> the remainder run north/south . The St . John ' s ha , acquired a lame number of tracts within the <br /> Fellsmere Farms Company ' s Subdivision and is , eeking abandonment of intervenins riehts - of wav <br /> to "clear title " and consolidate the propem for management purposes . <br /> ANALYSIS : <br /> The subject rights - of wav were established with the Fellsmere Farms Company ' s Subdivision plat <br /> in 1913 for the purpose of providing access and drainage improvements to area properties . The plat <br /> did not specifically dedicate the rights - of- wav to the county or any other entitN . .Althou2h the <br /> county ' s interest in the rights of wav is not clear. the applicant seeks to ensure that anv possible <br /> county interest in the rights - of- wav is abandoned in order to "clear title " for a consolidated land <br /> holding . The St . John ' s has already obtained a deed from the Fellsmere Farms Nkater Control <br /> District for these rights of stay . The applicant is now requesting that the Countv abandon am interest <br /> i [ may have . - - <br /> Per guidelines established by the Board of County Commissioners , this petition was reviewed by <br /> all county divisions and utility providers having jurisdiction or potential interests within the rishts - <br /> of- way . All reviewm2 agencies and departments have recommended approval of the requested <br /> abandonment . <br /> The subject rights -of- way are not part of the roadway system as noted on the Countv ThorouLyhfare <br /> Plan , and are not needed for the thoroughfare system . Furthermore , the abandonment would not <br /> affect the right of convenient access to surrounding properties because those properties are owned <br /> by the petitioner and will be managed rather than developed . Also . the County Attornev ' s Office <br /> has reviewed and approved the attached abandonment resolution for legal form and sufficiency . <br /> RECOMMENDATION : <br /> Staff recommends that the Board of County Commissioners abandon any rights the Countv has to <br /> the rights -of - way described in the attached resolution and authorize the Chairman of the Board of <br /> County Commissioners to execute the attached resolution . <br /> ATTACHMENTS : M+M.. w.. ee Re„ vvec Oty! a <br /> ANMIT <br /> 1 .
