DESCRIPTION R CONDITIONS : Attorney Steve Henderson , as agent . is requesting abandonment of a number of rights - of- w' ay on behalf of the St . John ' s River Water Management District . The nshts - ot- wav are part of the Fellsmere Farms Company Subdivision and are located south of the Town of Fellsmere and east of Willow Street (Please see attachment #2 ) . The majority of the rights -of- wav run east/west . while the remainder run north/south . The St . John ' s ha , acquired a lame number of tracts within the Fellsmere Farms Company ' s Subdivision and is , eeking abandonment of intervenins riehts - of wav to "clear title " and consolidate the propem for management purposes . ANALYSIS : The subject rights - of wav were established with the Fellsmere Farms Company ' s Subdivision plat in 1913 for the purpose of providing access and drainage improvements to area properties . The plat did not specifically dedicate the rights - of- wav to the county or any other entitN . .Althou2h the county ' s interest in the rights of wav is not clear. the applicant seeks to ensure that anv possible county interest in the rights - of- wav is abandoned in order to "clear title " for a consolidated land holding . The St . John ' s has already obtained a deed from the Fellsmere Farms Nkater Control District for these rights of stay . The applicant is now requesting that the Countv abandon am interest i [ may have . - - Per guidelines established by the Board of County Commissioners , this petition was reviewed by all county divisions and utility providers having jurisdiction or potential interests within the rishts - of- way . All reviewm2 agencies and departments have recommended approval of the requested abandonment . The subject rights -of- way are not part of the roadway system as noted on the Countv ThorouLyhfare Plan , and are not needed for the thoroughfare system . Furthermore , the abandonment would not affect the right of convenient access to surrounding properties because those properties are owned by the petitioner and will be managed rather than developed . Also . the County Attornev ' s Office has reviewed and approved the attached abandonment resolution for legal form and sufficiency . RECOMMENDATION : Staff recommends that the Board of County Commissioners abandon any rights the Countv has to the rights -of - way described in the attached resolution and authorize the Chairman of the Board of County Commissioners to execute the attached resolution .
