Collins II — Deputy County Attorney <br />DATE: June 27, 2002 <br />SUBJECT: Gifford Health Center <br />In the fall of 2001 the County Commission was approached by the Indian River <br />County Hospital District concerning the possible conveyance of approximately <br />31/2 acres west of 28th Avenue and north of 45th Street for a new Gifford Health <br />Center. The property had been platted as a cemetery in the early part of the <br />century but had been abandoned since the 1940s. In 1994 the County took over <br />possession of the property. The southern portion of the 10 -acre parcel has been <br />developed as a park site and also is the site of the historic Macedonia Baptist <br />Church. <br />The County Commission authorized the Hospital District to file suit in the name of <br />the County seeking good title to the property by virtue of adverse possession for <br />the statutory period of time The quiet title suit ended with an Order vesting title <br />to the property in the County. <br />By letter dated May 16, 2002 the Indian River County Hospital District requested <br />a conveyance of the north approximately 31/4 acres of the property to the Hospital <br />District for the establishment and operation of the new Gifford Health Center <br />Such conveyances are authorized by Florida Statute 125.38. The statute <br />requires a resolution be adopted by the Board approving such conveyance. <br />In order to vacate and annul the plat of Vero Beach - Burial Park, staff is <br />requesting authorization to replat the property into two tracts, with the southern <br />portion of the property being designated for park and recreational purposes as it <br />is currently utilized and with the northern approximately 3'/ acres being <br />designated as a tract to be conveyed to the Indian River County Hospital District <br />for the Gifford Health Center. <br />RECOMMENDATION: <br />1. Approve the attached resolution authorizing the conveyance to the Indian <br />River County Hospital District of the northerly +/- 31/2 acres. <br />Authorize the staff to proceed with a replat of the Vero Beach - Burial <br />Park. The name of the replatted property would be "Martin Luther King <br />Jr. Community Center" unless the Board prefers some other appellation <br />for the property. <br />WGC/nhm <br />cc: Alan Polackwich, Esq. <br />July 9, 2002 <br />13 <br />
