• Determination : Not a Substantial Deviation Request <br /> None of the proposed traffic condition changes in and of themselves constitute a substantial <br /> deviation as set forth in FS 380. 06 . However, the proposal to extend certain completion and <br /> build - out dates is presumed to constitute a substantial deviation since original completion <br /> dates have already been extended 5 years via previous amendments . However, the <br /> presumption can be rebutted by the applicant. In the case of this request, Grand Harbor has <br /> chosen to rebut the presumption via the traffic re- analysis and proposed traffic conditions . <br /> The re-analysis demonstrates that granting the newly requested completion build-out dates <br /> will not result in adverse traffic impacts. Therefore, the reviewing agencies and county staff <br /> have concluded that the re-analysis and proposed traffic conditions effectively rebut the <br /> presumption. Thus , the request should be considered to not constitute a substantial <br /> deviation . <br /> • Effects of the Amendment <br /> If adopted, the proposed amendment would : <br /> • Update certain street name and project phase name references . <br /> • More appropriately tie certain future off-site intersection improvements to project trip <br /> generation thresholds . <br /> • Establish an October 1 , 2005 re-analysis requirement (could be sooner if a certain specified <br /> trip threshold is exceeded) . <br /> • Provide more specific timeframes for implementing traffic signal improvements, if and <br /> when warranted. <br /> • Extend the completion date for total project build-out from 2005 to 2010. <br /> Neither county staff nor the reviewing agencies object to approval of the proposed amendment . <br /> RECOMMENDATION : <br /> Staff recommends that the Board of County Commissioners : <br /> 1 . Determine that the request does not constitute a substantial deviation. <br /> 2 . Adopt the attached resolution amending the Grand Harbor D .
