• • <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of September 17, 2002. <br />DESCRIPTION & CONDITIONS: <br />Carter Associates. Inc., on behalf of Legend Properties, Inc., is requesting planned development (PD) <br />special exception and preliminary PD plan/plat approval for a development to be known as "The <br />Reserve at Grand Harbor" The site is located immediately north of the intersection of Indian River <br />Boulevard and 53rd Street, just west of the River Club Golf Course. The applicant is requesting PD <br />approval to obtain waivers (modifications) for certan front. rear and side yard setbacks. No <br />reductions in lot sizes or widths are proposed. The PD plan proposes 86 single family detached <br />homes on individual lots. <br />The proposed development is located on 76.85 acres consisting of a portion of the former Whisper <br />Lakes golf course sire, and was recently incorporated into the overall Grand Harbor development of <br />regional impact (DRI). The proposed development will not increase the total number of units <br />approved within the Grand Harbor Development. and is consistent with the Grand Harbor DRI <br />development order change recently approved by the Board of County Commissioners on August 13 <br />2002. <br />• PD Project Process <br />The process involved in review and approval of the subject PD application is as follows: <br />Approval Needed Reviewing Body <br />1. Conceptual Plan/Special Exception PZC & BCC <br />2. Preliminary PD Plan/Plat PZC <br />3. Land Development Petinit (LDP) or Waiver Staff <br />4. Final PD (plat) BCC <br />The applicant is now requesting approval of the first two steps. If approved by the Board of County <br />Commissioners, the applicant will need to obtain an LDP 01 LDP waiver for the design of required <br />PD improvements from public works. <br />• Planning and Zoning Commission Action <br />At its regular meeting of August 22, 2002, the Planning and Zoning Commission voted unanimously <br />(5-0) to approve the Reserve at Grand Harbor preliminary PD plat/plan, subject to Board approval <br />of the special exception use request. In addition, the Planning and Zoning Commission voted <br />unanimously (5-0) to recommend that the Board of County Commissioners approve the special <br />exception use. Therefore, the preliminary PD plat/plan approval will become effective upon Board <br />approval of the special exception use. <br />The Board is now to approve. approve with conditions. or deny the special exception use request. <br />Pursuant to Section 971.05 of the LDRs, the Board is to consider the appropriateness of the <br />requested use for the subject site and surrounding area. The Board may attach any conditions and <br />safeguards necessary to mitigate impacts and to ensure compatibility of the use with the surrounding <br />area. <br />September 17, 2002 <br />51 <br />
