Bill North, 3012 Nassau Drive, Vero Beach. owns the property on the north of this <br />"street" and he has not been able to come to the same conclusion as staff. He read from <br />prepared notes which argued at length against the County's position. He had notified staff <br />that he would oppose the abandonment unless the property is split, half to the south and half <br />to the north. It did not seem logical and did not seem fair that the property should go to <br />Weona Park. He asked that if the Board decides to abandon Orange Street that it be split <br />because precedent was already set. <br />Commissioner Adams inquired if an easement would be retained by the County, and <br />Community Development Director Robert Keating responded in the affirmative. <br />Commissioner Neuberger's experience has been that abandonments are split between <br />the two abutting property owners. If the Board could not do that here, then the abandonment <br />should not be done. <br />Darrell Fennell, attorney at 979 Beachland Boulevard, representing Mr. Smith, <br />suggested that since there is no road there and there is no public need or reason to have a <br />road there, abandonment seemed appropriate. He believed that is not at issue. He thought <br />the next thing to do is abandon the road and let the chips fall as they may because the law <br />is going to apply. He took the position that the County had no role other than to abandon <br />it. He thought the law would support that this 25 feet was diminished from Weona Park and <br />that no part of it served to diminish the dimensions of Wabasso Court and Orange Street <br />would have no effect on Wabasso Court if it were to be given to thein. He was happy to <br />have it abandoned and then if Mr. Miller, the owner of the property to the south, feels that <br />he should share it, we will have our day in court and the court will decide who would get it, <br />not the Board. He felt that County Attorney Collins would confirm his statement. He did <br />not know how the other abandonments were split nor the reasoning used.
