PUBLIC HEARING - RESOLUTION NO. 2003-121 - <br />ABANDONMENT OF THE PORTION OF ORANGE STREET <br />LOCATED BETWEEN CR 510 AND 46TH AVENUE REQUESTED BY <br />ELSON SMITH (Legislative) <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING <br />IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />Planning Director Stan Boling reviewed the memorandum using aerial photographs <br />and other graphics to aid in the location of the road in question. He specified this is actually <br />a "paper street" through unimproved property and is not on any maps. He pointed out that <br />this "paper street" was established only on the Weona Park plat and thus if it is abandoned <br />it would only go to the property to the north and not to the property to the south. He noted <br />that surrounding property owners were notified and there had been contact with <br />correspondence in the backup that the property owner to the south wished for this to be split <br />in half. Staff's recommendation was to approve the request and abandon it. <br />Director Boling clarified State law for Commissioner Neuberger. He explained how <br />other abandonments in the area were handled. Staff concluded that the logic used in those <br />abandonments had no bearing on this request for abandonment as to any precedent having <br />been set. This one should be handled according to State law. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />September 23, 2003 <br />29 <br />
