1. It is empowered under the provisions of Chapter 971 to review the special exception use applied <br />for; <br />2. The granting of the special exception use will not adversely affect the public interest; <br />3. The application satisfies the general and specific criteria required for special exception approval; <br />and <br />4. The conditions stated below are adequate to ensure compatibility between the special exception <br />use and surrounding land uses. <br />Staff further recommends that the Board of County Commissioners grant special exception use <br />approval for the proposed group home facility with the following conditions. <br />1. The maximum capacity of the facility shall be 74 residents. <br />2. Prior to site plan release, the applicant shall: <br />a. Provide a certification from the Department ofHealth and Rehabilitative Services stating <br />the maximum capacity permitted in the proposed facilities; and <br />b. Execute a unity of title for the subject site and submit a copy to Planning Division staff. <br />3. Prior to issuance of a certificate of occupancy for the site, the applicant shall construct or bond - <br />out the required 12th Street sidewalk. <br />ATTACHMENTS <br />1. Application <br />2. Approved Minutes from 08/08/02 Planning and Zoning Commission Meeting <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />Pamela Waddell, 1200 10th Place, Vero Beach, advised that she and her neighbors <br />were concerned there would not be enough buffer and asked that a 6' privacy fence be <br />installed on the west side of the property, to the north and south, and on the south side of the <br />property, to the east and west. She presented a petition indicating that it was signed by the <br />neighbors. (PETITION IS ON FILE WITH THE BACKUP IN THE OFFICE OF THE <br />CLERK TO THE BOARD ) <br />September 3, 2002 <br />
