DeBl i , ICP <br /> Chief, Environmental Planning <br /> & Code Enforcement <br /> FROM : Kelly Zedek <br /> Code Enforcement Officer <br /> DATE : 8/28/01 <br /> RE : THOMAS WALTON REQUEST FOR RELEASE OF A PORTION OF AN <br /> EASEMENT AT 730 34TH CT SW (LOT 28, WALKING HORSE <br /> HAMMOCK SUBDIVISION) <br /> It is requested that the data herein presented be given formal consideration by the Board of County <br /> Commissioners at its regular meeting of September 4 , 2001 . <br /> DESCRIPTION AND CONDITIONS <br /> The County has been petitioned by Thomas G . Walton , owner of a lot at 730 34th Court SW , for <br /> release of a seven foot portion of a twenty-five foot wide rear yard drainage and utility easement <br /> (see attached drawing) on his lot. The purpose of the easement release request is to allow for <br /> construction of a pool and pool deck (see attached map ). <br /> ALTERNATIVES AND ANALYSIS <br /> The request has been reviewed by Bell South Communications ; Florida Power & Light Corporation ; <br /> T. C . I. Cable Corporation ; the Indian River County Utilities Department; the County Road & Bridge <br /> and Engineering Divisions ; and the County surveyor. None of the utility providers or reviewing <br /> agencies expressed an objection to the requested release of easement . Therefore . it is staff' s <br /> position that the requested easement release would have no adverse impact to utilities being <br /> supplied to the subject properties or to other properties . <br /> September 4 , 2001 <br /> 30 <br />
