k <br />ON MOTION by Commissioner Flescher, SECONDED <br />by Commissioner Davis, the Board unanimously approved <br />and authorized the Chairman to execute the Bus Shelter <br />Agreement and Permit with the City of Vero Beach for <br />use of public right -of --way, as recommended in the <br />memorandum of November 1, 2011. <br />AGREEMENT ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />ONIVOVEMBER 1.2011 <br />C. <br />Attorney DeBraal recalled that on November 1, 2011 the Board approved the purchase of <br />a right -of --way parcel located on the SW corner of 69th Street and 66th Avenue, formerly owned <br />by the Loudermilks, acquired by US Bank National Association (TRS), and now owned by <br />GMAC ResCap. He stated that in response to the Board's purchase offer of $139,000, GMAC <br />has requested the Board approve an addendum, in which they have outlined additional <br />stipulations to the purchase agreement. After recapping and analyzing the details of the <br />addendum, Attorney DeBraal confirmed staff's recommendation for the Board to approve the <br />addendum to the standard Purchase Contract with GMAC ResCap and proceed with the <br />acquisition of the subject parcel. <br />Commissioner Davis declared that due. to a conflict of interest, he would abstain from <br />voting on this matter. <br />ON MOTION by Commissioner O'Bryan, SECONDED <br />by Vice Chairman Wheeler, by a 4-0 vote (Commissioner <br />Davis abstained), the Board approved the addendum and <br />authorized staff to move forward with the purchase of the <br />right-of-way parcel on the SW corner of 691h Street and <br />W141PG 655 <br />November 8, 2011 15 <br />
