A discussion ensued on public access to the beach from the subject <br />property. <br />Attorney Reingold sought direction from the Board on whether to <br />explore options with the federal government on the release of <br />restrictions on the triangle portion of the Tracking Station Property. <br />ON MOTION by Commissioner Davis, SECONDED by Vice Chairman <br />Flescher, the Board unanimously directed the County Attorney to work <br />with the Town of Indian River Shores to come up with a plan on the <br />triangle portion of the Tracking Station Property under the deed <br />restrictions. <br />Humiston Park Property <br />Attorney Reingold stated that the property serves as over -spill public <br />parking for Humiston Beach Park. He explained there were <br />Resolutions stating the parking lot was for "park purposes", but there <br />is no evidence that the City obtained fee simple ownership of the lot. <br />Attorney Reingold sought guidance on how the Board wished to <br />proceed with respect to clarifying the ownership issue pertaining to the <br />parking lot. <br />MOTION WAS MADE by Commissioner O'Bryan, SECONDED by <br />Commissioner Davis, to grant to the City of Vero Beach, a quitclaim <br />deed for the parking lot located west of Ocean Drive across from <br />Humiston Park, with the condition that it remains zoned P-2 Park. <br />A discussion ensued on the ownership of the parking lot and keeping it <br />zoned as P-2 Park with the condition that no building could be built <br />over the parking lot. <br />MOTION WAS AMENDED by Commissioner O'Bryan, SECONDED <br />by Commissioner Davis, to give the City of Vero Beach a quitclaim <br />deed based on verification by the County Attorney that the parking lot <br />was zoned P-2 Park and that no building could be built over the <br />parking lot. <br />The Chairman CALLED THE OUESTION, and the Amended Motion <br />carried unanimously. <br />16th Street Parking Lot <br />Attorney Reingold stated that the County owned a substantial portion <br />of the 16th Street Parking lot; however, it was an unbuildable lot and <br />was considered as part of a right-of-way for 16th Street. <br />Board of County Commission Minutes Page 13 <br />April 12, 2016 <br />
