Greg Pheneger, 607 Cypress Rd. <br />Robert Schleis, 885 23rd Place SW <br />There being no additional speakers, the Chairman closed the Public Hearing. <br />MOTION WAS MADE by Commissioner Solari, <br />SECONDED by Commissioner O'Bryan, to adopt <br />Ordinance 2013-012, amending the code of Indian River <br />County to establish a new Chapter 316, entitled "Fertilizer <br />and Landscape Management;" adopting the Florida <br />Department of Environmental Protection's (FDEP's) <br />Model Ordinance for Florida -Friendly Use of Fertilizer on <br />Urban Landscapes, providing for severability, codification <br />and an effective date, with the following modifications <br />and findings: (1) fertilizer shall not be applied within ten <br />feet of any pond, stream, watercourse, lake, canal, or <br />wetland as defined by the Florida Department of <br />Environmental Protection, or from the top of a seawall; (2) <br />no fertilizer containing phosphorous shall be applied to <br />turf or landscape plants unless a soil or plant tissue <br />deficiency is verified by a University of Florida Institute <br />of Food and Agriculture Sciences approved testing <br />methodology, (3) the nitrogen content of fertilizer <br />applied to turf or landscape plants shall contain at least <br />50% slow release nitrogen per guaranteed analysis label; <br />and (4) there will be no exemptions from the above <br />additional requirements for licensed professional <br />applicators. <br />August 20, 2013 42 <br />BK 144PG220 <br />
