Commissioner Davis addressed a question about whether PNC was obligated to take on <br /> the sidewalk improvements . <br /> Vice Chairman O ' Bryan felt the deed restriction was rather open-ended, and suggested <br /> imposing a 10-year deadline for the developers to build the sidewalk improvements . <br /> Barry Segal P.A. , representing developer, GHO Homes, spoke in support of Attorney <br /> DeBraal ' s recommendation. He assured the Board that it is in his clients ' economic interest to <br /> move this project forward quickly. <br /> A brief discussion ensued among the Commissioners, staff, and Attorney Segal, during <br /> which it was decided to give the successor developers 10 years and a five-year grace period to <br /> complete the sidewalk construction. <br /> MOTION WAS AMENDED by Commissioner Flescher, <br /> SECONDED by Commissioner Davis, to stipulate a <br /> timeframe of 10 years and a five-year grace period for the <br /> successor developers to complete the sidewalk <br /> improvements. <br /> Attorney Segal stated that the deal breaker would be if his clients decide they cannot <br /> make the required improvements in 15 years . <br /> Commissioner Davis told Attorney Segal to let the Board know if it is a deal breaker. <br /> Commissioner Solari suggested stipulating the time frame as 15 years, omitting the <br /> verbiage about the five-year grace period. <br /> AMENDED MOTION was changed by Commissioner <br /> Flescher, SECONDED by Commissioner Davis, to Q <br /> 83 <br /> 8K 14 2 <br /> August 21 , 2012 38 <br />
