The exact location for the transmitter or transceiver shall be <br />determined by Lessor. Lessor shall provide Lessee with a means of <br />access to a transmitter or transceiver at all times during the term <br />of this Lease. Lessee may not operate the transmitter/transceiver <br />on any other frequency without the prior written consent of Lessor. <br />(iii) Any and all materials needed by Lessee for <br />operation of the antennae and transmitter/transceiver, including <br />line and fittings, shall be furnished by Lessee at Lessee's sole <br />expense. The transmission line installed by Lessee shall not <br />exceed 1-5/8 inches in diameter. All such materials shall be <br />installed so as not to interfere with or impede Lessor's access to <br />t he Tower and all parts thereof. <br />3. Oaeration and Maintenance. The operation of Lessee's <br />antennae and transmitter/transceiver shall in no way interfere with <br />t he use of the Tower by Lessor or any of its other lessees of the <br />Tower. <br />(A) Lessee will be responsible for the maintenance and <br />operation of Lessee's antennae and associated equipment so as tot <br />(i) Prevent any damage to the Tower or any <br />property attached or adjacent thereto. <br />(ii) Not interfere with the operation or <br />maintenance of any other part of the Tower, and other equipment <br />attached to or near the Tower. <br />(iii) Not interfere with others' radio equipment on <br />o r around the Tower. In the event that Lessee is notified of <br />interference, Lessee shall immediately take all steps necessary to <br />e liminate such interference, and if this is not accomplished within <br />twenty-four (24) hours from notice, then Lessee agrees to remove <br />all Lessee's equipment from the Lessor's premises, and this lease <br />shall become immediately null and void. <br />(iv) Comply with all applicable rules of the Federal <br />Communications Commission. <br />(v) Allow only authorized engineering or <br />maintenance personnel access to Lessee's antennae and equipment. <br />(B) Lessee understands that Lessor shall have no <br />liability for damage to Lessee's antennae or equipment (except that <br />caused by intentional act or gross negligence of Lessor or its <br />agents), from any cause whatsoever. <br />(C) Lessor shall allow reasonable access to Lessee's <br />antennae and equipment for installation and maintenance purposes <br />u nder supervision of Leeaor'a personnel. <br />
