' SECTION 00520 - Agreement ( Public Works ) ' THIS AGREEMENT is by and between INDIAN RIVER COUNTY, a Political Subdivision of the State of Florida organized and existing under the Laws of the State of Florida , (hereinafter called OWNER) ' and SITEWERKS . INC . ( hereinafter called CONTRACTOR) . ' OWNER and CONTRACTOR , in consideration of the mutual covenants hereinafter set forth , agree as follows : ' ARTICLE 1 = WORK 1 . 01 The Contractor shall be responsible for providing all equipment , material , and labor necessary to complete the proposed upland restoration activities . This work will include clearing to remove the existing vegetation and grove . Erosion and turbidity control measures will be installed per permit conditions ; surveying to identify the desired finished grades ; excavation and fill to re-establish natural grades ; construction of wetland features ( Empheral ponds ) ; and filling of drainage ditches ; planting of desirable native vegetation and installation of an irrigation system in areas of planted material . The Contractor will coordinate all of his/her work with the IRC Engineering Division , Christopher J . Kafer, Jr. , P . E . , County Engineer, Michelle Gentile , C . E . T . , Civil Engineer (772 ) 567-8000 extension 1221 & 1280 and Manager of Pelican Island National Wildlife Refuge , Paul Tritaik (772 ) 562-3909 ext. 244 . ' ARTICLE 2 - THE PROJECT 2 . 01 The Project for which the Work under the Contract Documents may be the whole or only a part is generally described as follows : Project Name : P . I . N . W . R . Upland Restoration County Project Number: 0386 Project Address : Pelican Island National Wildlife Refuge 11325 Jungle Trail Vero Beach , Florida 32968 ARTICLE 3 — ENGINEER ' 3 . 01 The Indian River County Public Works Department is hereinafter called the ENGINEER and will act as OWNER's representative , assume all duties and responsibilities , and have the rights and authority assigned to ENGINEER in the Contract Documents in connection ' with the completion of the Work in accordance with the Contract Documents . ARTICLE 4 - CONTRACT TIMES 4 . 01 Time of the Essence A.
