ARTICLE 1 = RECOGNITION <br /> Section 1 : Indian River County Emergency Services District (the Employer) recognizes <br /> Teamsters Local 769 (the Union) as the sole and exclusive bargaining agent, with respect <br /> to wages, hours and working conditions of employment, for the employees in the <br /> bargaining unit as established by PERC Certification No . 1381 , granted by the Florida <br /> Public Relations Commission, attached as Appendix "A. " <br /> Section 2 : The Union recognizes the County Administrator as the exclusive <br /> representative for the County. The Union, its agents and representatives agree to bargain <br /> collectively pursuant to Florida Statute 447 only with the County Administrator (or <br /> designee) . <br /> ARTICLE 2 - MANAGEMENT RIGHTS <br /> Section 1 : Subject to the provisions of this Agreement, it is the right of the County to <br /> unilaterally : <br /> a) Determine the purpose of each of its constituent agencies ; <br /> b) Set standards of services to be offered to the public ; <br /> c) Exercise control and discretion over its organization and operations ; <br /> d) Manage and direct its workforce, including the right to take disciplinary <br /> action for proper cause; hire, promote, rehire, recall, demote for cause, <br /> transfer, lay-off or relieve its employees from duty because of a lack of <br /> work or other legitimate reasons ; <br /> e) Schedule and assign work to be performed. <br /> Section 2 : It is the intent and understanding of the parties that any rights, privileges or <br /> obligations which are not specifically granted to the Union and the employees by this <br /> Agreement are retained by the County. <br /> Section 3 : This Agreement sets forth all covenants, stipulations and provisions agreed <br /> upon by the parties hereto , and no agent or representative of either party has the authority <br /> to make, and none of the parties shall be bound by or be liable for, any statement, <br /> representation, promise, inducement or agreement not set forth herein. This Agreement <br /> spells out the total agreement in its entirety between the parties, including wages, hours, <br /> working conditions and all fringe benefits . <br /> Section 4 : If in the sole discretion of the County Administrator, it is determined that civil <br /> emergency conditions exist or may exist, including, hurricane conditions, similar <br /> catastrophes or disorders, this Agreement may be suspended by the County Administrator <br /> during the time of the declared emergency, provided that wage rates and other direct <br /> monetary payments shall not be suspended. <br /> 1 <br />
