ARTICLE 3 = SEVERABILITY <br /> Section l : It is not the intent of either party to violate any laws or any rulings or <br /> regulations of any governmental authority or agency having jurisdiction of the subject <br /> matter of this Agreement . The parties hereto agree that in the event any provision of this <br /> Agreement is held to be unlawful or void by any tribunal having the right to so hold, the <br /> parties shall meet within thirty (30) days to negotiate a substitute article(s) . The <br /> remainder of this Agreement shall remain in full force and effect, unless the parts so <br /> found to be void are wholly inseparable from the remaining portions of the Agreement. <br /> ARTICLE 4 - DISCRIMINATION <br /> Section 1 : The Employer and the Union affirm their joint opposition to any <br /> discriminatory practices in connection with employment. Employees shall be treated in a <br /> respectful manner without regard to religion, disability, marital status, political affiliation, <br /> race, color, creed, national origin, gender or age . <br /> ARTICLE 5 - UNION BUSINESS <br /> Section l : Union business conducted by any employee while on duty shall not interfere <br /> with the employees ' normal duties, unless the local union representative has been <br /> requested by the County to act in a Union capacity . <br /> ARTICLE 6 - CONTRACTING OR SUB-CONTRACTING <br /> Section 1 : If the County is considering contracting out, reassigning or sub-contracting <br /> any work, which will eliminate bargaining unit positions, the County shall notify the <br /> Union sixty (60) days prior to the effective date of the decision. The Union shall be given <br /> the opportunity to present their position to the County Commission. Nothing shall limit <br /> the County' s right to subcontract work. <br /> ARTICLE 7 - LAY-OFF <br /> Section 1 : The County retains the unilateral right to determine the number of employees. <br /> In the event of a lay-off, the County will make every effort to give as much notice as <br /> possible. The County shall provide employees at least thirty (30) days notice of lay-off. <br /> Employees shall be laid off in reverse order of seniority. <br /> 2 <br />
