programs, or safety practices, nor shall the Consultant have any authority or responsibility to stop or
<br /> direct the work of any contractor.
<br /> While it is not anticipated that there will be hazardous materials or conditions encountered on this project,
<br /> should any such conditions be discovered during this scope of services, the Consultant shall notify IRCU
<br /> of hazardous substances or conditions not contemplated in this Scope of services of which the Consultant
<br /> actually becomes aware . Upon such notice by the Consultant, the Consultant may stop affected portions
<br /> of its services until the hazardous substance or condition is eliminated. The parties shall decide if the
<br /> Consultant is to proceed with the services and if the Consultant is to conduct testing and evaluations, and
<br /> the parties may enter into further agreements as to the additional scope, fee, and terms for such services .
<br /> ASSUMPTIONS and Additional Services
<br /> L It is assumed that ground-water, sediment quality, and surface water quality data monitoring in the
<br /> project area will not be necessary and is not provided under this scope.
<br /> 2 . Surveying and bathymetry outside of existing available data and beyond the scope listed herein can be
<br /> provided, as additional services .
<br /> 3 . Monitoring beyond what is listed herein and as defined by the DEP during the ERP process.
<br /> 4. Environmental Resource Permitting services in vicinity of Marsh Island, if necessary.
<br /> SCHEDULE
<br /> The scope described herein is anticipated to take approximately ten to fourteen months from notice to
<br /> proceed. Kimley-Horn will work diligently to have the permitting scope complete within two months,
<br /> and bid the project concurrently with the permitting process in order for construction to commence prior
<br /> to hurricane season. However, permitting agency review, bidding, and contractor delays are beyond our
<br /> control and make take longer than anticipated.
<br /> Permitting and bidding: 2 - 4 months
<br /> Construction: 10 - 12 months
<br /> Total t2 - 16 months
<br /> FEES
<br /> Consultant will provide these services in accordance with our non-exclusive professional Consulting
<br /> Agreement dated April 6, 2004 . Consultant will provide these Services as described herein on a lump
<br /> sum basis as follows :
